How The Contract Is Formed Between You And Us

After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the product has been dispatched (the Dispatch Confirmation). The contract between us (Contract) will only be formed when we send you the Dispatch Confirmation.

The Contract will relate only to those products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Dispatch Confirmation.

VAT

All items purchased from us include VAT at the prevailent rate.

Payment Validation

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

In addition, in the interests of preventing fraudulent use of credit, debit and charge cards, we will validate the names, addresses and other information supplied during the order process against commercially available records (e.g Electoral Roll data, Credit Reference Services). A third party may also be instructed to complete these checks. By ordering from the www.silksandshoes.com website you consent to such checks being made. We may need to contact you by letter, telephone or email to verify details before we are able to process and dispatch your order or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information. These measures are taken as extra protection for you, to ensure your online shopping experience with us is as safe and secure as possible.

Delivery And Shipping Info

All goods are quality checked, hand packaged and despatched within 1 working day of your cleared payment.

UK Delivery

All UK orders are despatched by the Royal Mail service selected upon checkout.

Carriage to mainland UK is free of charge on condition that we have a full UK address with postcode. Should you not be at home to sign for your goods when they are delivered, Royal Mail will leave a card detailing alternative delivery instructions. If there are any problems with your delivery please do not hesitate to email us and we will supply the posting reference. This can be used to track your order via the Royal Mail Track and Trace Service.

EU Delivery (Outside of UK)

All EU orders are despatched by Royal Mail International Signed For Delivery at a cost of £6.95GBP per item.

Carriage to European Union Countries is charged at £6.95GBP sterling per item on condition that we have a full address with post/area code. Please note this £6.95 is an excess postal charge for international tracking and insurance and is not refundable if the shoes are returned.

Should you not be at home to sign for your goods when they are delivered, your postal carrier should leave a card detailing alternative delivery instructions. If there are any problems with your delivery please do not hesitate to email us and we will supply the posting reference. This can be used to track your order and find out the location of your goods via the Royal Mail Tracking link at the bottom of this page.

We can only send your goods to the credit cardholders address.

We can only supply to EU Member Countries.

Returns

Please e-mail with details of your return to returns@silksandshoes.com before returning your goods. We will then e-mail a returns form, which MUST be enclosed in the package. We will also send details of the address of where to return the goods to.

The goods must be returned immediately on receipt of the Returns Form in the same unused/undamaged condition in which you accepted them, with all of the original packing materials and at your own insurance risk and cost. We suggest you use Royal Mail Special Delivery, as no refund will be made for lost items.

When the goods have been received by us we will process the refund within seven days from the date we received them. The refund will be made by the same method and into the same account from which your original payment was made.

In the case of unwanted/unsuitable goods we will refund the price of the goods in full. However, you will be responsible for the cost of returning and insuring them.

In the rare event that you receive a faulty product please contact us for further instructions on returning it. We will process a full refund within seven days of us receiving the goods back. All return costs will be refunded in full.

If you need to return the goods for any other reason than the above we will only refund the cost of the goods, you will be responsible for the cost of insuring and returning the goods to us.

You have a legal obligation to take reasonable care of the goods whilst they are in your possession. Please ensure the sizing and suitability are correct before wearing outdoors. Shoes that show signs of outdoor wear will be returned to the buyer as unsalable and a refund will not be made. All returns should be returned in there original condition, unworn with all the original packing materials in order to obtain a refund.

We can only refund the credit/debit card or PayPal account originally used for payment. We cannot handle exchanges. If you wish to change your item please arrange a return and place a new order on our website.

Statutory Rights

Your UK statutory rights are not affected by our returns policy.

Our Liability

We warrant to you that any product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which the product was designed.

Our liability for any losses you may suffer as a result of a breach of this agreement is strictly limited to the purchase price of the product you purchased.

This does not include or limit in any way our liability:

a. For death or personal injury caused by our negligence

b. Under section 2(3) of the Consumer Protection Act 1987

c. For fraud or fraudulent misrepresentation; or

d. For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

We are not responsible for indirect losses.

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.

Notice

Any notice given by you to us must be given to Silks and Shoes Ltd at enquiries@silksandshoes.com. We may give notice to you at either the e-mail or postal address you provide to us when placing an order. Notice will be deemed received and properly served 24 hours after an e-mail is sent or three days after the date of posting of any letter. In providing the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

General

Silks and Shoes Ltd reserves the right to refuse any order without disclosing why such order was refused. We will notify you if your order is refused.

Stock Availability

The confirmation e-mail you receive is a confirmation that we have received your order and not a guarantee of stock availability. If we are unable to fulfill your order, we will cancel and refund your payment, we will let you know as soon as possible.

Sizing

All product sizes are as stated and labelled by the maufacturer of such items, www.Silksandshoes.com accept no liability for sizing of such items.

Accuracy of Content

We have taken every care in the content of this website to ensure accuracy; however some prices or details shown on the website could change from time to time and it is possible that errors will occur. We will endeavour to rectify any errors as quickly as possible. Should an error occur we will give you the option of either confirming your offer to purchase subject to the correct description or price or retracting your offer and receiving a refund if the goods have already been paid for.

The contract between you and us is binding on you and us and on our respective successors and assigns.

This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law, and you and we agree to submit to the non-exclusive jurisdiction of English courts for the determination of disputes.
